Foreclosures & Legal Issues Focus Group PresentsTopic: Bankruptcy and Foreclosure
NW REIA Meeting: Tuesday, July 25, 2017 – 6:30 pm
Moderator: Dick Uffelman, Attorney
Guest Speaker: Clarke Balcom, Attorney

Do you know the answers to the following questions?  If you can’t answer 95% of these questions with certainty, you should attend the Pre/Post Foreclosure Meeting.

  1. Is it true that bankruptcy filing can stop a foreclosure?
  2. What is the automatic stay?
  3. If I owe income taxes to the IRS or the Oregon Department of Revenue, can I discharge them by filing bankruptcy?
  4. Can I get out of alimony and child support by filing for bankruptcy?
  5. I filed bankruptcy only 5 years ago.  Am I eligible again or do I have to wait for a specific time frame?
  6. What are the differences between a Chapter 7, a Chapter 11 and a Chapter 13 bankruptcy?
  7. I couldn’t pay the second mortgage on my house so I filed bankruptcy and the debt was discharged.  The trustee has abandoned the house (let it come back to me) because there is not enough equity in it.  Can I now sell it free of the second mortgage since the debt is discharged?
  8. Are there some debts which cannot be discharged in bankruptcy?
  9. I’m a real estate agent and I have a deal pending.  Unfortunately, on the eve of closing, the seller filed bankruptcy.  Can I still get a commission when the property closes?  Since I brought a willing and able buyer to the table, am I entitled to a commission if the trustee refuses to go through the sale?
  10. I would like to file bankruptcy but then agree to pay back a certain number of debts so my good creditors get paid but the bad ones get shafted.  Is that ok?
  11. I’m going to have to file for bankruptcy.  I would like to take care of several of my creditors before the filing and then file bankruptcy to discharge all the other debts.  Can I do that?  Is there some time frame involved?
  12. What is an insider?  If I am an insider, what are the rules that determine if I am getting preferential treatment? Do insiders come under a different rule than other creditors?
  13. I’m a general creditor of the bankrupt debtor and the trustee is about to sell some of the estate properties for a lowball price – there won’t be enough money to pay all the creditors. What can I do?
  14. When can a foreclosure or short sale result in income taxes, and what are the exceptions and alternatives to this?
  15. My wealthy uncle is on his death bed. I’ve seen his will and my share will be enough to pay off all my credit cards. Can I file now, discharge my debts and wait for my uncle to pass and keep all the money?
